Some Senate Democrats Support Telecoms Over Constitution

While it took time, Bush is getting what he wants, courtesy of all his lock-step rubber stamp Republicans and some so called Democratic senators: retroactive immunity for telecoms.

Here are some of those Democrats who spat on the Constitution and rule of law:

"The Dodd/Feingold Amendment 3907 to strip retroactive immunity from the underlying SSCI bill just failed, 31-67. 51 votes were needed to pass.

"Voting with the Republicans were the following eighteen Democrats (again, rough count):

"Bayh, Inouye, Johnson, Landrieu, McCaskill, Ben Nelson, Bill Nelson, Stabenow, Feinstein, Kohl, Pryor, Rockefeller, Salazar, Carper, Mikulski, Conrad, Webb, and Lincoln. Joe Lieberman also voted against stripping retroactive immunity."

As Glenn Greenwald writes: "The Senate today -- led by Jay Rockefeller, enabled by Harry Reid, and with the active support of at least 12 (and probably more) Democrats, in conjunction with an as-always lockstep GOP caucus -- will vote to legalize warrantless spying on the telephone calls and emails of Americans, and will also provide full retroactive amnesty to lawbreaking telecoms, thus forever putting an end to any efforts to investigate and obtain a judicial ruling regarding the Bush administration's years-long illegal spying programs aimed at Americans.

"What were the consequences for the President for having broken the law so deliberately and transparently? Absolutely nothing. To the contrary, the Senate is about to enact a bill which has two simple purposes: (1) to render retroactively legal the President's illegal spying program by legalizing its crux: warrantless eavesdropping on Americans, and (2) to stifle forever the sole remaining avenue for finding out what the Government did and obtaining a judicial ruling as to its legality: namely, the lawsuits brought against the co-conspiring telecoms. In other words, the only steps taken by our political class upon exposure by the NYT of this profound lawbreaking is to endorse it all and then suppress any and all efforts to investigate it and subject it to the rule of law."

I wrote a posting last week, "Dems To Give Bush Telecom Retroactive Immunity, Thanks to Harry Reid," that included this: "Reid brought to the Senate floor the Senate Intelligence Committee's (chaired by Jay Rockefeller, so called Democrat, from West Virginia who is in the pocket of telecoms) bill, that granted retroactive immunity to telecoms and other Bush demands as the base bill rather than the Senate Judiciary Committee's bill which did not and provided stronger oversight requirements."

"The Senate Majority Leader also refused to honor the hold placed on the flawed FISA bill by fellow Democrat Senator Chris Dodd, even though he previously honored holds, even egregious ones, placed by GOP senators!"

Today these spineless Democratic senators joined their Bushite rubber stamp colleagues and voted to cover up Bush and the telecoms' crimes and do the bidding of an imperial, authoritarian president and telecoms whose money fills senatorial campaign purses. These dishonorable senators have unforgivably betrayed the Constitution, rule of law, and the American people. They do not deserve to be re-elected by their constituents.

Dahlia Lithwick at Slate has concisely explained the relationship between the dangerous idiot in the White House and the nominally Democratic controlled Congress: "First, the administration breaks the law in secret. Then it denies breaking the law. Then it admits to the conduct but asserts that settled law is not in fact settled anymore because some lawyer was willing to unsettle it. Then the administration insists that the basis for unsettling the law is secret but that there are now two equally valid sides to the question. And then the administration gets Congress to rewrite the old law by insisting it prevents the president from thwarting terror attacks and warning that terrorists will strike tomorrow unless Congress ratifies the new law. Then it immunizes the law breakers from prosecution."

Senate Majority Leader Harry Reid is not a real Democrat or a leader given FISA debacle which he made possible.  We need real Democrats in the Senate; those who voted against the Dodd-Feingold amendment are not.
